Search requests made using our Service may produce results or reference sites or information throughout the Internet and the world. You understand that Jason Rundell has no control over such sites and information, including but not limited to their accuracy, content, quality or currency. Jason Rundell assumes no responsibility for your search leading you to unintended, objectionable, inaccurate or otherwise unwanted material, even if your search has been deliberately diverted by a third party. The Internet has abundant adult and/or objectionable material throughout its network, and we make no promises that we can safeguard you or your minor children from such material. You agree that in order to intentionally access areas known by you to contain adult content you must be at least 18 years of age.

You are responsible for keeping confidential your account information, including your password. You are responsible for all uses of your account, whether or not all uses have been authorized by you.

Listing your URL or company information within JoinMii.net grants Jason Rundell permission to send e-mail to your supplied e-mail address. The e-mail you receive from us will generally be notification of updates or changes to our site or services and is intended to be informational, not "nuisance" e-mail. Jason Rundell will never sell your contact information to third parties for any reason.

Forums and Other Posted Information

As a user of this service, you understand that users alone are responsible for the contents of the messages they communicate as well as the consequences of those messages. You agree that you will never use our services for illegal activities or to send any message or material that is unlawful, harmful, threatening, racist, abusive, defamatory, obscene, harassing, libelous, invasive of another's privacy or gives rise to civil liability or otherwise violates the standards described anywhere on our site(s). You Agree not to glamorize violence, upload images of persons that appear to be under 10 years of age, post threatening content, post your own or other peoples contact information. You further agree not to upload vile, obscene or pornographic images. You further agree not to use our services for the purpose of sending SPAM, chain mail, mass solicitations or other e-mail annoyances. You assume complete and total responsibility for any material you transmit. You further understand and agree that any material (including but not limited to images, text and/or information) you receive is the sole responsibility of the sender and that Jason Rundell assumes no responsibility for what may be sent to you or to others. Any violation of TOS may result in immediate deletion of a user's account without prior notice. We have the right at any time to remove content or images that have been submitted to the web site.

Chat and bulletin board communications are public and NOT private communications and the user agrees not to post information in such places that he or she wants to keep private. Although Jason Rundell reserves the right to delete any posting for any reason, Jason Rundell is not responsible for monitoring such communications for content. As a user of this service, you understand such communications may expose you to objectionable content that is not under Jason Rundell's obligation to delete.

You understand and agree that JoinMii.net's services are provided "AS-IS" and that Jason Rundell assumes no responsibility whatever for the timeliness, deletion, misdelivery or failure to store any user communications or personalization settings.

You agree to indemnify, defend and hold harmless Jason Rundell, his subsidiaries, affiliates, officers, agents, directors, consultants, co-branders and/or other partners and employees from any claim or demand made by any third party (including but not limited to reasonable attorneys' fees), arising out of use of JoinMii.net's Service, content you or another party may submit, post or transmit through the Service, your use of the Service, your connection to the Service, your or another's violation of the Terms of Service, your or another's violation of another's rights, or infringement by any other user of your account. The TOS will inure to the benefit of Jason Rundell's successors, assigns and licensees.

Jason Rundell assumes no responsibility for damage, real or perceived, caused to you or any third party by suspension or termination of its services.

This web site is available to members over the age of 10 unless you have received written consent from your parent or legal guardian. By becoming a member, you agree that you are the age of or over 10 years. You agree that the information you register with is truthful and accurate. JoinMii.net is meant for people over 10 years old and we will not knowingly allow persons under the age of 10 to use our service without written consent from their parent or legal guardian.

By submitting any form of content whether written or your photograph(s), you give Jason Rundell, continual, non-exclusive, worldwide, royalty-free rights and license to use your submitted content for reproduction on new or current web sites owned by Jason Rundell. Change and/or adapt and have distribution rights to promote the content in any form, in all media now known or newly created anywhere in the world for any purpose.

ANY MATERIAL AND/OR DATA YOU DOWNLOAD OR OBTAIN THROUGH ITS SERVICES IS AT YOUR OWN DISCRETION AND RISK AND YOU AGREE YOU ARE COMPLETELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR ANY OTHER DAMAGE THAT RESULTS FROM THE DOWNLOAD OR USE OF SUCH MATERIAL.

JASON RUNDELL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. JASON RUNDELL MAKES NO WARRANTY OR REPRESENTATION REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF ITS SERVICES, NOR DOES IT WARRANTY THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH ITS SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM JASON RUNDELL, OR THROUGH USE OF THE JOINMII.NET SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

JASON RUNDELL WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE JOINMII.NET'S SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, UNAUTHORIZED ACCESS TO OR ALTERATION OF A USER'S TRANSMISSIONS OR DATA, OR STATEMENTS OR CONDUCT OF ANY THIRD PARTY USING THE SERVICE. JASON RUNDELL IS NOT LIABLE FOR ANY DAMAGES, REAL OR PERCEIVED, CAUSED BY OR RELATING TO USE OF THE SERVICE, EVEN IF JASON RUNDELL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms of Service constitute the agreement in its entirety between you and Jason Rundell with respect to the subject matter hereof and supercedes and replaces all prior understandings and/or agreements between you and Jason Rundell.
